Mar 28, 2019
Quick Previous governor of Osun State, Rauf Aregbesola has reacted to the judgment of the Election Petition Tribunal which nullified the election of Governor Gboyega Oyetola, final Friday.
Aregbosola who expressed shock over the judgement mentioned the tribunal’s verdict is not going to stand.
In an announcement Wednesday evening by his Media Adviser, Mr. Sola Fasure, Aregbesola mentioned: “In nullifying the elections within the 17 polling models, the bulk judgment predicated it on what’s thought to be ‘substantial non-compliance’ with the provisions of the Electoral Act 2010. The mentioned non-compliance, in line with the judgment, borders on the failure of INEC’s appointed presiding officers to document accreditation and poll accounting on the consequence kinds within the 17 polling models.
“There was no proof of any act recognized to render election null and void in an election petition comparable to over voting, non-accreditation, poll field stuffing and many others.
“This a lot was highlighted within the dissenting judgment of the Chairman of the Tribunal in disagreeing with the bulk determination.
“It should be famous that APC and its candidate weren’t accused of any electoral malfeasance within the 17 polling models. Somewhat, INEC, a typical agent of PDP and APC (and certainly, all of the political events), which neither of the events has management over was merely accused of not complying with its guide for the election, when the presiding officers appointed for the election didn’t make the entries.
“Due to this fact, probably the most related query one would pose right here is: ought to the tribunal permit APC to endure because of the errors or omissions occasioned by the INEC employees? Actually, no!”
“Equally stunning are the explanations superior by the 2 justices. They superior the proposition that elections within the seven polling models had been cancelled by the state collation officer. This was not the case. There have been no elections within the seven polling models, and if there was any, the onus was on the petitioners. This onus was not discharged in anyway as no outcomes was tendered.
“The state collation officer in compliance with the margin of lead precept rightly reasoned that the outcomes of the elections couldn’t be decided with out conducting polls within the affected elections. Therefore the fee’s determination to conduct supplementary elections consistent with these ideas.”
